A second asbestos lawsuit was filed for Mr. James Bennett, who had already sued the 26 defendant corporations and won a settlement for a non-malignant asbestos-related illness. This time the plaintiff is seeking damages over a malignant asbestos-related disease.
Mr. Bennett and his wife Lucille Bennett filed the complaint in Jefferson County District Court on March 21.
According to the suit, Bennett was a millwright and carpenter, and was exposed to asbestos and asbestos products, as a result of which he became ill. Bennett’s employment dates are not mentioned in the complaint.
The defendants made, supplied or used asbestos products, but failed to warn workers about the risks associated with them, the suit says.
Judge Bob Wortham will preside over the case.
