New York – Two NY residents were indicted on 11 counts of illegal removal and disposal of asbestos, according to the United States Attorney for the Northern District of New York.
63-year-old John Mills and 54-year-old Terrance Allen were charged for allegedly conspiring to defraud the U.S. and to breach the Toxic Substances Control Act, Clean Air Act and the Superfund Act.
The defendants allegedly used unlicensed and untrained individuals for asbestos removal, and failed to report the asbestos-related job to the Environmental protection agency (EPA) as mandated by law. The alleged violations took place in Malone buildings John Mills owns.
According to the indictment, the defendants violated the Clean Air Act by not informing the EPA before carrying out a renovation project involving asbestos removal at 144 Elm Street.
The defendants are facing up to five years in federal prison and a fine of up to $250,000 for each count of the indictment.
